Terms and Conditions – Satra Ayurved

1. Disclaimer of Consequential Damages

In no event shall Satra Ayurved or any affiliated individuals, organizations, or entities mentioned on this website be held liable for any damages whatsoever (including, without limitation, incidental or consequential damages, lost profits, loss of data, or business interruption) resulting from the use or inability to use our website, services, or materials. This applies regardless of the legal theory (contract, warranty, tort, etc.) and whether or not such parties were advised of the possibility of such damages.

2. Indemnification

You agree to indemnify, defend, and hold harmless Satra Ayurved, its affiliates, employees, directors, officers, and partners from any and all claims, damages, liabilities, losses, and expenses (including legal fees) arising out of or related to:
(i) your use or misuse of Satra Ayurved’s website or services;
(ii) any violation of these Terms and Conditions; or
(iii) any breach of representations or warranties made by you herein.
Satra Ayurved reserves the right to assume exclusive defense and control of any matter subject to indemnification by you and you agree to cooperate fully in such defense.

3. Dispute Resolution

If any dispute or disagreement arises regarding this Agreement or the use of Satra Ayurved’s services, both parties shall attempt to resolve it amicably within 30 days of written notice. If resolution is not reached, the matter may be referred to binding arbitration under the Indian Arbitration and Conciliation Act, 1996. Each party shall bear its own legal costs. This clause shall survive the termination of this Agreement.

4. Governing Law and Jurisdiction

These Terms & Conditions shall be governed by the laws of India. Any legal disputes shall be subject to the exclusive jurisdiction of courts located in Hooghly, West Bengal. This clause shall survive termination of this Agreement.

5. Limitation of Liability

You agree that Satra Ayurved shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from:

• Use or inability to use the services;

• Unauthorized access to or alteration of your transmissions or data;

• Any third-party conduct or statements through the service;

• Or any other matter related to the service.
  In any event, the total liability of Satra Ayurved shall not exceed the amount paid by the user, if any, for accessing or using the services related to the claim.
